Terms and Conditions
The Terms and Conditions for Spanish Property Auctions which are held in our Spanish Head Office.
The highest bidder of each property shall be the purchaser thereof. If any dispute arises as to the highest bidder, the Auctioneer shall determine the dispute and may put up again and re-sell the property in respect of which the dispute lies. All properties sold through Spanish Property Auctions will be subject to a reserve price or above. Please note that guide prices stated are for guide use only and are not to be confused with the reserve price which will obviously not be the same as the guide price. At Spanish Property Auctions the reserve price is the lowest price that the seller will accept and is agreed with the Auctioneer. This price is confidential and shall only be known to the seller and the Auctioneer and no other third party.
- Once you have successfully bid on, and purchased your property you shall be required to pay a 3.000 Euro reservation deposit to Baldwin & Hall S.L. Alternatively you will need to provide proof that you have lodged the deposit with your legal representative or lawyer. Please note that reservation fees can be paid by either by cash, a bankers draft, or credit card.
- Should anyone wish to bid on behalf of a friend, colleague or family member then please speak to the Auctioneer before the auction starts so that we can avoid confusion and you will not be the person that has purchased the property as opposed to the person themselves.
- Purchasers will need to provide identification such as an NIE number, current drivers licence, valid passport or drivers license, on the day of the auction.
- Any changes or amendments to the brochure will be announced in the auction room prior to the auction taking place. Purchasers are deemed to have purchased with the full knowledge of the information provided. The purchaser is deemed to have accepted the changes to the brochure but in the unlikely event that the particulars differ from those stated, the purchaser has the right to a full refund.
- If, for any reason that you are unable to attend the auction personally you may if you wish to instruct the auctioneer to bid on your behalf by proxy.
Proxy forms will be on hand on the day of auction and on-line. Please note that each proxy form must have a cheque of 3000 Euro's attached, or proof that the reservation fee is held in their lawyers account and be accompanied by a letter on the lawyers letter-headed paper stating that this reservation fee will be released should you be successful. On-line bids will be recognised as the same as proxy, as long as the same terms and conditions apply to the proxy forms.
We at Spanish Property Auctions accept telephone bids as long as proof of the reservation is held with their lawyer or representative.
- If, for any reason should the property not pass the survey, or there are further undisclosed problems with the property documents, buyers are entitled to a full refund of their reservation fee
- If required, all relevant documentation for the properties are available for your inspection before auction, if not and you are successful with your purchase we then make sure that all documentation is in order.
